DUI Child Endangerment because of a note?

A couple of months ago in North Tonawanda New York, a woman was arrested for DUI after her nine year old daughter held up a note in the car window that said "please help us."  Fellow drivers noticed the message and called 911.  Police pulled over the woman who had two other minor children in the car and ended up arresting her for drunk driving and child endangerment
