ALS Hearings
Many people are unaware that a DUI charge actually starts the clock for two different cases against you: the criminal case that most people are familiar with, and the case with the Department of Driver Services. Most people do not know about the case with DDS and a failure to take action will result in an automatic suspension of your driver's license. Within 30 days, you must request an Administrative License Suspension (ALS) hearing or have your license automatically suspended.
We talk to clients all the time who are confused about this and had no idea that there are two hearings and two court proceedings in separate court systems. The criminal case will happen to you whether or not you request an ALS hearing. This is why you were given an actual court date when you were released from custody. In addition, your license is automatically suspended unless you request a separate ALS hearing or the ignition interlock device. This hearing or device is requested by the 30-day letter. The hearing will be before a different court and a different judge. It has nothing to do with the criminal proceeding against you.
